Terms of Service
These Terms of Service are an agreement between ChildCare Kiosk ("we", "us") and the daycare, child care program or business that opens a ChildCare Kiosk account ("you"). By creating an account, ticking "I agree", or using the service, you agree to these terms and to our Privacy Policy. The person who agrees confirms they may do so for the daycare.
1. The service
ChildCare Kiosk is web software for running a daycare's front door and office: child sign-in and sign-out with signatures, staff clock-in, a visitor log, documents and immunization records, food menus, online applications, reports and exports (including an attendance export laid out for entering in CAPS Online), and a parent portal. We may improve and change features over time.
2. Accounts and users
- The information you give us when you sign up must be accurate, including your license details.
- You are responsible for the people you give access to, for the roles you give them, and for keeping passwords, tablet passwords and PINs private.
- Tell us promptly if you believe your account has been used without your permission.
3. Subscription and payment
- A new account that signs up on our website starts with a 30-day free trial. No card is needed to start it.
- After the trial, the service is offered by subscription. The plan, price and billing period are shown to you before you subscribe, and fees are charged in advance for each billing period.
- Fees are not refundable except where the law requires it or we agree in writing. Taxes, if any, are added.
- We may change prices with advance notice; a change applies from your next billing period.
- If a payment fails or a subscription ends, the account is locked until it is renewed. Your records are kept, not deleted, while it is locked.
4. Your data
- The records you put into the service belong to you. We use them only to provide the service, as our Privacy Policy describes, and we never sell them.
- You are responsible for having the right to record the information you enter about children, families, staff and visitors, including any consent the law requires from parents or guardians, and for telling families how you use it.
- You can download a full copy of your records and files at any time.
5. Acceptable use
You agree not to:
- use the service for anything unlawful, or to record information you have no right to hold;
- try to reach another account's data, or probe, overload or disrupt the service (security research is welcome under the rules on our Security page);
- upload malware, or files that are not what they claim to be;
- copy, resell or reverse engineer the service, or share sign-in details between people.
We may suspend access that breaks these rules or puts others at risk. Where we can, we will tell you first.
6. Government programs and your records
The service helps you keep records and prepare information. It does not replace your own judgment. You are responsible for the accuracy of everything you submit to any government or subsidy program (for example CAPS), and for meeting your licensing requirements. The service never submits, certifies or files anything to such a program for you: you review and submit it yourself.
7. Availability and support
We aim to keep the service available and working well every day, and to fix problems quickly. There may be planned maintenance. Support is by email through our contact page.
8. No warranty
The service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we do not promise that the service will be uninterrupted or free of errors.
9. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, revenue or data. Our total liability for any claim about the service is limited to the amount you paid us for it in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
10. Termination
- You can close your account at any time from the portal. Download your data first if you want a copy.
- A closed account can be reopened for 30 days. After that it is permanently erased, as our Privacy Policy describes.
- We may suspend or end an account that seriously or repeatedly breaks these terms, does not pay, or if we stop offering the service. Unless the law or a security risk prevents it, we will give notice and time to export your data.
11. Changes to these terms
We may update these terms. We will change the date and version at the top and tell you before an important change takes effect; we may ask you to agree to the new version to keep using the portal.
12. Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Disputes will be heard in the state or federal courts located in New York.
